EVERBRIGHT ACH ENROLLMENT AMAZON.COM eGIFT CARD PROMOTION

These Terms and Conditions apply to the EVERBRIGHT ACH ENROLLMENT AMAZON.COM EGIFT CARD PROMOTION ("Promotion") being conducted by EVERBRIGHT, LLC. This Promotion begins on Monday, April 3, 2023, at 12:01 AM (ET) and ends on Sunday, April 30, 2023, at 11:59 PM (ET) (the "Promotion Period"). THIS PROMOTION IS VOID WHERE PROHIBITED BY LAW.

Eligibility

THIS PROMOTION IS NOT OPEN TO THE GENERAL PUBLIC. DO NOT PROCEED IN THIS PROMOTION IF YOU ARE NOT AN EVERBRIGHT CUSTOMER WHO IS ELIGIBLE PURSUANT TO THESE TERMS AND CONDITIONS. 

This Promotion is open only to EverBright's customers as of Monday, April 3, 2023, who are 18 years of age or older as of April 3, 2023 and who have received an email or letter from EverBright requesting their participation in the Promotion. A person is a “customer” of EverBright if they have an active account for which the person currently owes payments. Employees of EverBright, its respective subsidiaries, affiliates, eGift card suppliers, and advertising and Promotion agencies, including Administrator, and their immediate families (spouse, parents, children and siblings and their respective spouses) and individuals living in the same households of such employees are ineligible to participate. 

How to Enroll

Visit https://billing.accountservicing.com and log into your Billing & Payment portal. Register for AutoPay (hereinafter referred to as "ACH Enrollment") by clicking on the "Click here to sign up for AutoPay!" button and follow the steps to add your account details. All EverBright customers who receive this offer and enroll in ACH between 12:01 AM (ET) on April 3, 2023, and 11:59 PM ET on April 23, 2023, will receive a $40 Amazon.com eGift Card. EverBright customers who receive this offer and enroll in ACH between 12:00 AM on April 24, 2023, and 11:59 PM ET on April 30, 2023, will receive a $20 Amazon.com eGift Card.

The offer ends on Sun., April 30, 2023, at 11:59 PM (ET). All ACH enrollments must be received by 11:59 PM (ET) Fri., April 30, 2023, to qualify for the promotion. LIMIT: Only one eGift card per EverBright contract ID. By entering into this Promotion, each participant agrees to EverBright's use of his/her personal information as described in EverBright's website privacy policy https://www.goeverbright.com/privacy-policy) and in these Terms and Conditions. In the event of any discrepancy between the privacy policy and these Terms and Conditions, these Terms and Conditions shall control and govern.

Available eGift Cards

The following eGift card options will be provided to a customer with enrollment under these Terms and Conditions:

$40 Amazon.com eGift Card will be awarded to EverBright customers who have received this offer and made a valid new ACH enrollment between 12:01 AM (ET) on April 3, 2023, and 11:59 PM on April 23, 2023; or
$20 Amazon.com eGift Card will be awarded to EverBright customers who have received this offer and made a valid new ACH enrollment between 12:00 AM on April 24, 2023, and 11:59 PM on April 30, 2023.

EverBright is not affiliated with Amazon.com or any of its affiliates. By participating in this Promotion, you agree that EverBright is not responsible for the terms and conditions governing the Amazon.com eGift card or for any errors, omissions, or performance by Amazon.com.

How to Receive an eGift Card

The eGift card will be sent via email to eligible recipients. If you are an eligible recipient, you will receive your Amazon eGift Card via email within 3 to 5 weeks after first successful ACH payment is made. Recipient may be required to provide EverBright with proof that he/she is the authorized EverBright account holder of the address associated with an eligible ACH Enrollment. 

General Conditions

ANY TAXES, FEES AND SURCHARGES ON THE eGIFT CARD ARE THE SOLE RESPONSIBILITY OF THE RECIPIENT. 

The eGift card will be forfeited if the potential recipient is in non-compliance with these Terms and Conditions or cannot be contacted, provides incorrect email or mailing address, is ineligible, fails to claim the eGift card, or if the notification is returned as undeliverable. In that event, no alternate recipient will be selected. 

By entering this Promotion, you agree to be bound by these Terms and Conditions. 

All participants agree (i) to be bound by all applicable U.S. laws and regulations, as well as these Terms and Conditions, (ii) to waive any right to claim ambiguity in these Terms and Conditions, and (iii) to release, indemnify and hold harmless EverBright, and its respective affiliates, subsidiaries, agents, representatives, promotion and advertising agencies, and their respective employees, officers, directors, shareholders and agents (collectively, “Releasees”) from and against any injuries, losses, damages, claims, actions any liability of any kind resulting from or arising from participation in the Promotion or acceptance, possession, use, misuse or nonuse of the eGift card. Releasees are not responsible for printing or typographical errors in any promotion-related materials; for ACH Enrollments that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason; or for electronic or computer malfunction or error, including any injury or damage to a participant's or any other person's computer relating to or resulting from participation in this Promotion or downloading any materials in this Promotion, or inability to access any website associated with this Promotion, or process any transaction thereon.

If in EverBright's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Promotion, or if computer viruses, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Promotion, EverBright reserves the right at their sole discretion to disqualify any individual from eligibility for the Promotion under these Terms and Conditions. Moreover, EverBright reserves the right to rescind or change these Terms and Conditions or the Promotion at any time without notice. ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, EVERBRIGHT RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Any attempts by an individual to access any website associated with this Promotion via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible. This Promotion is conducted in English (which will be given its everyday ordinary meaning).  The Promotion and these Terms and Conditions shall be governed in all respects by and construed in accordance with the laws of the State of Florida without regard to conflicts of law principles.  Any action under applicable law, suit in equity or other proceeding against EverBright with respect to any term or provision of the Promotion or these Terms and Conditions shall be brought and maintained in the Federal District Court, Southern District of Florida, or the Circuit Court of Palm Beach County, Florida.  YOU HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT THAT MAY EXIST TO HAVE A TRIAL BY JURY IN RESPECT OF ANY LITIGATION BASED UPON OR ARISING OUT OF, UNDER, OR IN ANY WAY CONNECTED WITH THE PROMOTION.

Participation in the Promotion is not required to obtain any goods and/or services or as a condition for financing with any party. The Promotion shall in no way be construed as a sweepstakes or lottery under federal or state law. Participation in the Promotion is free and all eligible persons who participate in the Promotion and comply with these Terms and Conditions will be eligible for an eGift card, as described more fully in these Terms and Conditions.
